Terms of Use

These Terms of Use (hereinafter the “Terms”) govern access to and use of the website pattayahomes.net, together with all related sub-domains, personal accounts, forms and electronic communications (hereinafter collectively the “Services”), operated by Homehunter (Thailand) Co., Ltd., a company duly incorporated under the laws of the Kingdom of Thailand, having its registered office at 267/4, Moo 12, Nongprue, Banglamung, Chonburi 20150, Thailand (hereinafter the “Company”, “we”, “us” or “our”). Any natural or juristic person accessing or using the Services is referred to as the “User” or “you”.

By accessing or using the Services, submitting any request or creating an account, you acknowledge that you have read, understood and agree to be bound by these Terms and by the Privacy Policy, which forms an integral part hereof. If you do not agree to these Terms, you shall not use the Services.

1. Nature of the Services

1.1 The Services constitute an online platform through which the Company advertises residential real property in Pattaya and surrounding areas available for lease or sale, and through which Users may submit booking requests, viewing requests, enquiries and property listings.

1.2 Unless expressly stated otherwise in a written agreement, the Company acts as an agent or intermediary between Users and the owners of the relevant real property (hereinafter the “Owners”). The Company is not the owner of the properties presented through the Services.

1.3 Nothing contained in the Services shall constitute an offer capable of acceptance. All information is provided by way of invitation to treat only.

1.4 Booking requests, viewing requests and other enquiries may be submitted online through the Services. The confirmation of a booking and the conclusion of a lease or sale agreement are separate stages, as set out in Clause 2.

2. Booking requests

2.1 A booking request submitted through the Services constitutes a non-binding expression of interest. It does not create a lease, reservation or any other contractual obligation on the part of the Company or the Owner.

2.2 A booking shall be deemed confirmed (hereinafter a “Confirmed Booking”) only upon (a) written confirmation issued by the Company and (b) receipt by the Company of the reservation deposit or advance payment specified in such confirmation. Until a Confirmed Booking arises, the property may be leased to any other party without notice.

2.3 A Confirmed Booking reserves the property for the dates stated therein. The lease itself shall be concluded only upon execution of a written lease agreement by the parties thereto, which shall take place no later than the commencement of occupancy. The reservation deposit shall be applied, refunded or forfeited in accordance with the terms of the written confirmation and the lease agreement.

2.4 The availability calendar displayed in the Services is indicative and is updated on a reasonable-efforts basis. The Company does not warrant that any date shown as available will remain available at the time of confirmation.

2.5 The minimum lease term for all properties presented through the Services is thirty (30) days. The Company does not offer daily or short-term accommodation within the meaning of the Hotel Act B.E. 2547 (2004).

2.6 The terms of occupancy, including the amount and refund of the security deposit, payment schedule, utility charges, house rules, termination and cancellation, shall be governed exclusively by the lease agreement executed between the parties. In the event of any inconsistency between information presented in the Services and the executed lease agreement, the lease agreement shall prevail.

3. Status and availability information

3.1 Any indication in the Services regarding the status of a property, including without limitation “available”, “booked”, “newly listed”, “reserved”, “let”, “sold”, counters of listings, booking requests or views, and availability dates, is generated by automated systems and/or manual entry, is provided for general information purposes only and may be incomplete, delayed or inaccurate, including as a result of technical error.

3.2 The display of a property in the Services does not constitute a representation or warranty that such property is available for lease or sale at any given time. A property may have been leased, sold, reserved or withdrawn by the Owner without such change being reflected in the Services.

3.3 The actual status and availability of any property shall be determined solely by written confirmation issued by the Company.

4. Prices and discounts

4.1 All prices are stated in Thai Baht (THB). Any amounts shown in other currencies are approximate, provided for information purposes only, calculated at indicative exchange rates and shall not be binding.

4.2 Unless expressly stated otherwise, prices displayed in the Services relate to rent or purchase price only and exclude electricity, water, internet, common area fees and any other charges. The existence, amount and manner of payment of any such charges shall be determined exclusively by the lease or sale agreement between the parties thereto. Any utility rates or fees displayed in the Services are indicative only and shall not be binding.

4.3 Discounts and promotional prices, including discounts applied to specific date ranges, are valid only for the dates and conditions displayed at the time of the request, are subject to confirmation by the Company, and may be amended or withdrawn at any time prior to confirmation.

4.4 The Company reserves the right to correct any error in prices or information, including after a request has been submitted but before confirmation.

5. Property information

5.1 Descriptions, photographs, videos, floor areas, floor numbers, views, amenities and other information relating to properties are provided in good faith based on information available to the Company and/or supplied by Owners. Photographs and videos may be illustrative and may not reflect the current condition, furnishing or decoration of the property.

5.2 The Company makes no representation or warranty, express or implied, as to the accuracy, completeness or currency of such information. Users are advised to inspect the property in person or by video prior to entering into any agreement.

5.3 With respect to properties offered for sale, information concerning foreign ownership quota, title, transfer fees, taxes and other legal or financial matters is indicative only and is subject to verification at the relevant Land Office and by the User’s own legal advisers prior to completion of any transaction.

6. Viewing requests

Viewing requests are subject to confirmation by the Company and to the availability of the property and of the Company’s staff. The Company may reschedule or cancel a viewing where necessary.

7. Property listings submitted by Owners

7.1 By submitting a property listing, the Owner represents and warrants that (a) the Owner is the lawful owner of the property or is duly authorised by the lawful owner, (b) all information and materials submitted are true and accurate, and (c) the Owner holds all rights necessary to grant the licence set out in Clause 7.3.

7.2 The Company is under no obligation to publish any listing and may, at its sole discretion and without giving reasons, review, edit, decline, suspend or remove any listing. Listings are not published automatically.

7.3 The Owner grants the Company a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, watermark and publish the submitted descriptions, photographs and videos for the purpose of marketing the property through the Services and the Company’s other marketing channels.

8. User accounts

8.1 Users are responsible for maintaining the confidentiality of the means of access to their account and for all activities carried out through their account.

8.2 The Company may suspend or terminate any account which is used in breach of these Terms or applicable law, or which remains inactive for an extended period.

9. Acceptable use

Users shall not: (a) submit false, misleading or fraudulent requests or information; (b) use the Services for any unlawful purpose, including the offering of short-term accommodation in breach of applicable law; (c) copy, scrape, harvest or systematically extract content or data from the Services by automated means; (d) interfere with or disrupt the operation or security of the Services; or (e) use the Services to send unsolicited communications.

10. Intellectual property

All content of the Services, including texts, photographs, videos, logos, trade names, design and software, is the property of the Company or its licensors and is protected under the Copyright Act B.E. 2537 (1994) and other applicable laws. No part of the Services may be reproduced, distributed or used for commercial purposes without the prior written consent of the Company.

11. Limitation of liability

11.1 The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special or consequential loss or damage, including loss of profit, loss of opportunity or loss of data, arising out of or in connection with the use of or inability to use the Services.

11.2 The Company shall not be liable for any act, omission, default or representation of any Owner, tenant, buyer or other third party, nor for the condition of any property, save to the extent such liability cannot be excluded under applicable law.

11.3 The Company shall not be liable for any interruption, delay or unavailability of the Services, or for the content of any third-party website linked from the Services.

12. Indemnity

The User shall indemnify and hold harmless the Company, its directors, employees and agents from and against any claim, loss, damage, liability, cost or expense (including reasonable legal fees) arising out of the User’s breach of these Terms or violation of any law or rights of a third party.

13. Amendments

The Company reserves the right to amend these Terms at any time. Amended Terms shall take effect upon publication on the Services, and the effective date indicated above shall be updated accordingly. Continued use of the Services after such publication shall constitute acceptance of the amended Terms.

14. Severability and language

14.1 If any provision of these Terms is held to be invalid or unenforceable, such provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.

14.2 These Terms are drawn up in the English language. Any translation is provided for convenience only, and in the event of any inconsistency the English version shall prevail.

15. Governing law and jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts of the Kingdom of Thailand.
